5/31/15 Defendant passes Plaintiff’s house, turns left into neighbors driveway across street, allegedly to turn around. Plaintiff backs, out turning 90 degrees and is hit by defendant’s rear bumper. Leaves scene providing only first name and does not return. (cvc20002). If turing around, Defendant would have gone in opposite direction, avoiding contact.
6/5/15 Defendant’s husband leaves phone message, accusing Plaintiff and tries to scam a cash settlement.
6/10/15 Defendant files SR-1 accident report with DMV, does not tell Plaintiff is obligated to file. USAA Casualty Insurance sends an extortion demand for unspecified damages, threatens retribution for not complying.
6/15/15 Defendant gets estimate at Chilton’s Body Shop for $963.17, forwards to USAA and subsequently to Farmer’s Insurance. Does not notify Plaintiff.
6/19/15 USAA writes Defendant check for $963.17.
6/19-6/23/15 USAA receives Plaintiff’s response to demand letter, retaliates by telling Defendant to switch to Multi-Craft Body Shop.
6/23/15 Multi-Craft issues invoice for $1,366.17 upon delivery of car, never does their own estimate (required).
6/24/15 Adjuster, licensed only in Arizona, alters Chilton’s estimate to increase labor hourly rate and adds undocumented repairs to match invoice.
6/25/15 Defendant’s husband picks up car and pays $963.17.
9/15 Plaintiff receives copies of alleged damage photos that show white paint on an unbroken taillight that’s five inches higher than Plaintiff’s black rear bumper.
6/7/16 Plaintiff receives 68% increase in insurance premiums due to chargeable accident.
8/1/16 Plaintiff files insurance fraud complaint with San Mateo County Superior Court.
